Terms and Conditions

1. Introduction

Welcome to "All-in-HerFlow." These Terms and Conditions govern your use of our website and SaaS platform. By accessing or using our services, you agree to comply with these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.

2. Definitions

Service refers to the "All-in-HerFlow" SaaS platform provided by Anna Elizabeth Consulting ABN: 15 563 643 992. User refers to any individual or entity who accesses or uses the Service. We/Us/Our refers to Anna Elizabeth Consulting and its affiliates. Content includes text, images, videos, software, and other materials available on the Service.

3. Use of Service

Users must be at least 18 years old to use the Service. Users must provide accurate information during the registration process and keep their account information updated. Users may not engage in activities that are illegal, harmful, or disruptive to the Service or other users.

4. User Responsibilities

Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. Users agree to comply with all applicable laws and regulations while using the Service. Users retain ownership of the content they create but grant us a license to use, distribute, and display such content as necessary to provide the Service.

5. Fees and Payment

Users agree to pay all fees associated with their subscription to the Service. Subscription fees are billed in advance on a recurring basis as specified during the sign-up process. All fees are non-refundable except as required by law.

6. Intellectual Property

We retain all rights, title, and interest in and to the Service and its content, including all intellectual property rights. Users are granted a limited, non-exclusive, non-transferable license to access and use the Service for their personal or business use.

7. Privacy

We collect and use personal data in accordance with our Privacy Policy. We implement measures to protect user data but cannot guarantee absolute security. Users must implement and enforce their own Privacy Policy for their customers.

8. Termination

You may cancel your account at any time by submitting the All-in-HerFlow Cancellation Form on https://allinherflow.com/cancellation or emailing support at [email protected]. Your account will be cancelled within 72 hours of your cancellation request. Cancelling your account will completely DELETE your entire account, including all data, content, and records, which cannot be recovered or retrieved once cancelled. Users are responsible for ensuring that all of their content, data, and information is fully backed up before cancelling their account. Anna Elizabeth Consulting accepts no liability for any loss of data. Once cancellation is confirmed, all of your content will be immediately deleted from the Services. Since deletion of all data is final, please be sure that you do in fact want to cancel your account before doing so. If you request that your content be deleted, Anna Elizabeth Consulting will not be held responsible for any data that is lost. We reserve the right to modify or terminate the Service for any reason, without notice, at any time.

Cancellation Under Fraud Protection:

Without limiting any other remedies, All-in-HerFlow may prevent you from creating an account or suspend or terminate any account that you create if we suspect that you have, or may have engaged in fraudulent activity in connection with the Services.

All-in-HerFlow reserves the right to change, pause, suspend, or cancel your account at any time.

9. Disclaimers and Limitations of Liability

The Service is provided "as is" without any warranties, express or implied. We shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of the Service.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Victoria, Australia.

11. Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Users will be notified of any significant changes, and continued use of the Service constitutes acceptance of the revised terms.

13. Services and Payment

The Provider agrees to provide the Services to the Client for the Fees outlined in the Schedule. The Client must pay all Fees in accordance with the Payment Options in the Schedule. All Fees are GST inclusive. The Client shall pay each amount by the due date without set-off or deduction. Interest applies to overdue amounts as per the Penalty Interest Rates Act 1983 (Vic).

14. Commencement of Services

The Provider is not obliged to commence or continue Services if Fees are unpaid.

15. Consumer Rights and Guarantees

Services are sold with consumer guarantees as per the Competition and Consumer Act 2010 (Cth). For material breaches, the Provider will re-supply the Services or refund a proportionate amount of the Fees.

16. Risk

The Provider is not liable for any injury or harm incurred by the Client during the provision of Services. The Client should seek medical advice before participating in the Services.

17. Intellectual Property

Intellectual property remains the property of the Provider. The Client must not alter the Provider’s intellectual property without consent.

18. Confidentiality

The Client’s information will be kept confidential and not disclosed without consent.

19. Miscellaneous

These Terms and Conditions will be governed by the laws of Victoria and the parties agree to submit to the jurisdiction of the Victorian Courts. The Provider’s waiver of any provision or breach of these Terms and Conditions shall not be construed as a waiver of any other provision or breach. In the event of any inconsistency between the Special Conditions in the Schedule and these Terms and Conditions, the Special Conditions will take priority. The Provider may subcontract any part or all of the Services.
